That kind of complexity wouldn't map cleanly to their intuitions and preconceptions. That would put very unwelcome pressure on their attempt to ground all morality in those intuitions. So I think they'd want to simplify the situation by defining her as whatever gender she most closely resembles. If she couldn't be easily pigeonholed as female, they'd want to shrink and limit the exception as much as possible.

I would lay money the answer you'd get is "She's a female with birth defects". They'd declare chromosomes to be the acid test.

...in that particular case. If the chromosomes were botched, they'd declare sex characteristics to be the obvious acid test. It's all Special Pleading, case-by-case, by morons.

I don't think "Burn the abomination!" can be entirely ruled out.
